Terms of service

Last updated 18 September 2026.

/01The agreement

These terms are between you, the club, and Harry Mattocks trading as Memberly, 6 Wiltshire Drive, Congleton, Cheshire, CW12 1NX. They apply from the moment you create an account.

/02The service

Memberly gives your club a membership recommendation widget, an admin dashboard and a public API. Trials are free; after that a subscription is payable monthly in advance through Stripe. Cancel whenever you like and the service runs to the end of the period you have paid for. We do not refund part-months.

We may change how the service works. If a change materially reduces what you get, we will tell you at least thirty days beforehand and you may cancel.

/03Your side

  • You are the data controller for everything your members put into the finder. You decide what it asks and why.
  • You publish a privacy notice to your members covering that data. We generate one for you in Settings; check it, fill in the bracketed details and keep it accurate.
  • You do not use the finder to collect special category data — health, ethnicity, beliefs and the rest — or payment card details.
  • You keep your sign-in details to yourself and tell us promptly if an account is compromised.
  • Your tiers, questions and knowledge base stay yours. You give us permission to host and display them.

/04Data processing

This section is the written contract required by Article 28(3) of the UK GDPR. You are the controller; we are your processor.

Subject matter and duration. Processing members' personal data so the finder can run, for as long as your account is open.
Nature and purpose. Collecting quiz answers, scoring them, storing the result, reporting aggregate usage, and — if you switch them on — generating explanations, answering member questions and capturing email leads.
Types of personal data. Quiz answers, age band, gender where you ask for it, email address where a member asks for their result, chat messages, referring website and campaign tags, and a per-visit reference.
Categories of data subject. Members and prospective members of your club who use the finder.

We will:

  • process personal data only on your documented instructions, which these terms and your settings in the dashboard form, including for transfers outside the UK, unless the law requires otherwise — in which case we will tell you first unless the law forbids it;
  • make sure everyone who handles the data is under a duty of confidence;
  • take appropriate technical and organisational security measures, as Article 32 requires: encryption in transit, row-level tenant separation tested in our test suite, hashed passwords, and access limited to those who need it;
  • engage a sub-processor only with your authorisation. You authorise the ones listed on our sub-processors page; we will give you thirty days' notice by email before adding or replacing one, you may object, and if we cannot resolve the objection you may cancel. Every sub-processor is bound by the same obligations, and we stay liable to you for what they do;
  • help you respond to members exercising their rights — the dashboard lets you export, delete and erase data yourself, and we will help with anything it cannot do;
  • help you with security, breach notification, data protection impact assessments and consultations with the ICO, and tell you without undue delay if we become aware of a personal data breach;
  • delete all members' personal data within thirty days of your account closing, or return it first if you ask, unless the law requires us to keep it;
  • make available the information you need to show we are meeting these obligations, and allow and contribute to audits and inspections by you or an auditor you appoint, on reasonable notice and no more than once a year unless there has been a breach.

We also keep the members' data inside your account only, and we do not use it for our own purposes.

/05Availability and liability

We aim to keep Memberly available but do not promise it will be uninterrupted or error-free, and it is provided without warranties beyond those the law implies. Neither of us limits liability for death or personal injury caused by negligence, fraud, or anything else the law will not let us limit. Otherwise our total liability in any twelve-month period is capped at the fees you paid us in that period, and neither of us is liable for loss of profit, goodwill or data.

/06Ending it

You may close your account at any time from Settings, which deletes your club and everything in it immediately. We may suspend or end the agreement if you break these terms and do not put it right within fourteen days of being asked, or if payment fails repeatedly.

/07Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
